Terms of Service

Effective date: 1 April 2026

1. Introduction

These Terms of Service ("Terms") govern your use of the wireless internet services provided by Intellinet Fibre Solutions ("we", "us", or "our"), a registered internet service provider based in the Western Cape, South Africa.

By subscribing to or using our services, you agree to be bound by these Terms, our Privacy Policy, and all applicable South African law, including the Electronic Communications Act, Consumer Protection Act (CPA), and the Protection of Personal Information Act (POPIA).

2. Service Description

Intellinet provides uncapped wireless internet connectivity via fixed wireless infrastructure in the Western Cape. Our services include:

  • Wireless internet access at various speed tiers
  • A router/CPE device provided for the duration of service
  • Access to the client portal for account management and payments

Service availability depends on coverage in your area and line-of-sight to our network towers.

3. Subscription and Billing

  • All subscriptions are month-to-month with no fixed-term contract.
  • Monthly fees are due in advance on or before the 1st of each month.
  • Payments are processed securely via Yoco. We do not store your card details.
  • A once-off installation fee may apply and will be communicated at signup.
  • Failure to pay by the due date may result in service suspension.
  • Prices are in South African Rand (ZAR) and include VAT where applicable.

4. Acceptable Use

You agree not to use our services to:

  • Engage in any unlawful activity or violate any South African law
  • Distribute malware, spam, or unsolicited communications
  • Infringe on intellectual property rights
  • Interfere with or disrupt network infrastructure
  • Resell or redistribute your connection without written permission
  • Engage in excessive bandwidth usage that degrades service for other users

We reserve the right to suspend or terminate service for violations of this policy, with or without notice depending on severity.

5. Equipment

  • A router/CPE device is provided to you for the duration of your subscription and remains the property of Intellinet.
  • You are responsible for the safekeeping and reasonable care of the equipment.
  • Damaged or lost equipment may be charged to you at replacement cost.
  • Equipment must be returned in working condition upon cancellation of service.

6. Service Availability

While we strive to provide reliable, uninterrupted service, we cannot guarantee 100% uptime. Service may be affected by:

  • Scheduled maintenance (we will notify you in advance where possible)
  • Weather conditions, power outages, or force majeure events
  • Network congestion during peak hours
  • Third-party infrastructure failures

We aim to resolve outages promptly and will communicate major disruptions via WhatsApp, email, or our social media channels.

7. Cancellation

  • You may cancel your service at any time by contacting us via email, phone, or WhatsApp.
  • Cancellation takes effect at the end of the current billing period. No pro-rata refunds are given for partial months.
  • All equipment must be returned within 7 days of cancellation.
  • Outstanding balances must be settled before or at the time of cancellation.

8. Limitation of Liability

To the maximum extent permitted by South African law:

  • Intellinet is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use our services.
  • We are not responsible for data loss, security breaches on your devices, or third-party content accessed through our network.
  • Our total liability for any claim shall not exceed the amount you paid for services in the preceding month.

Nothing in these Terms excludes liability that cannot be excluded under the Consumer Protection Act or other mandatory legislation.

9. Data Protection

We process your personal information in accordance with POPIA. For full details, please refer to our Privacy Policy. By using our services, you consent to the collection and processing of your personal information as described therein.

10. Dispute Resolution

In the event of a dispute:

  • We encourage you to first contact us directly to resolve the matter informally.
  • If unresolved, the dispute may be referred to mediation or the relevant consumer tribunal under the CPA.
  • These Terms are governed by the laws of the Republic of South Africa, and any legal proceedings shall be subject to the jurisdiction of the Western Cape High Court.

11. Modifications to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Where changes materially affect your rights, we will endeavour to notify you via email or the client portal. Continued use of our services after changes are published constitutes acceptance of the updated Terms.
